David Smith

Partner at BROWNGREER, PLC

David has overseen various aspects of claims administration with a focus on the pharmaceutical and medical device matters since joining BrownGreer in 2004.

In the $4.85 billion Vioxx settlement announced in November of 2007, David directly supervised the processing of almost 60,000 alleged heart attack and stroke claims to assess the claims for qualifying injuries, timely proof of usage and medical risk factors to determine a final settlement award. Additionally, David coordinated the reporting of all governmental and private health care liens for Vioxx claimants and withheld the proper amounts for valid liens. David also coordinated standard reporting to the parties (plaintiffs, defendants, Special Masters, appointed committees) and developed interactive web portals to post and exchange data on the Vioxx settlement program.

David coordinated and supervised an almost $8 million settlement involving OxyContin and coordinated the notice campaign, claimant registration, determination of settlement benefits, payments, lien withholdings and future drug treatment services.

For Wyeth, David continues to monitor settled claimants, maintain the active dockets of remaining diet drug cases and appeals and ensure the timely dismissal of all settled claims from state or federal courts.

David's prior legal experience includes five years as an associate with the law firm of McSweeney & Crump, P.C. in Richmond, Virginia. His diverse practice included corporate work, mergers and acquisitions, general business law, bankruptcy and creditor's rights, immigration, intellectual property, commercial and construction litigation and a sophisticated collections practice. David accumulated extensive courtroom experience by representing national retailers and property owners in his bankruptcy practice, and by representing several large construction contractors in insurance, surety and mechanic's lien disputes.

After graduation from law school, David served as in-house counsel for CarMax Auto Superstores, Inc. in Richmond, Virginia. He assisted CarMax in opening its dealerships in multiple states by researching state and federal compliance issues relating to dealer licensing, consumer lending law, debt collection practices, franchise law, advertising regulations, retail installment contracts, credit applications, warranty disclaimers and various other automotive laws.
