We have also acted for financiers in restructures, secured recoveries, receiverships and mortgagee sales.  In addition to negotiating asset management agreements, sale agreements and joint venture development agreements we have provided extensive advice with respect to mortgagee’s and receiver’s duties under the Corporations Act and the Property Law Act.

In addition to transactional matters we have advised in respect of compliance issues including the National Consumer Credit Protection Act, Personal Property Securities Act, Banking Code of Practice, Anti-Money Laundering and Counter-Terrorism Financing Act, Privacy Act and other relevant legislation.  We have prepared credit code compliant suites of documents and manuals as well other standard form documentation for use by short term lenders, receivables financiers and other boutique financiers.

We have also acted extensively for borrowers and guarantors including review and negotiation of facility documents and provision of independent legal advice certificates.  We also have the trust and respect of financiers when acting for borrowers and guarantors in default situations.

We also accept instructions from other law firms and professional advisers to assist their clients with specialist advice or documentation.  We can be engaged on a disclosed or undisclosed basis including preparation of "white-label" documentation.
