Joshua Weigensberg is a member of the Litigation and Media + Entertainment Groups, where he litigates copyright and trademark matters and other complex commercial disputes for clients in a range of industries including music, technology, art, consumer goods, information services, and real estate.

Josh regularly represents IP owners seeking to enforce their rights as well as companies and creators accused of infringement. Within the music industry, he has represented record labels, publishers, artists, and songwriters in a variety of disputes, including ones involving infringement claims and disputes over licensing terms. Apart from litigating IP matters, he also assists clients with applying for and obtaining copyright and trademark registrations.

Josh’s IP cases frequently involve technology issues and opponents from Big Tech. He has litigated two complex rate-setting proceedings against Amazon, Apple, Google, Pandora, and Spotify (Phonorecords III and IV). These proceedings set nationwide rates for royalties payable by music streaming companies. The Phonorecords III proceeding resulted in a landmark increase in royalty rates for 2018-2022 of nearly 44%, and is currently on remand before the Copyright Royalty Board (“CRB”). In the historic settlement of the Phonorecords IV proceeding, after extensive litigation, the participants agreed to new rates beginning in 2023, which the CRB approved in December 2022.
