Rachel Mihai is a partner at the Newport Beach office of Bremer, Whyte, Brown & O’Meara LLP. Ms. Mihai is licensed to practice law in California. Ms. Mihai has been with the firm since 2007. She practices general liability litigation. This includes focus on large loss general liability claims, traumatic brain injury and other catastrophic injury claims, public entity defense, landlord and property management claims, premises liability, real estate and construction related claims. She also has experience in Fair Housing and ADA (Americans with Disabilities Act) claims. Ms. Mihai has litigated matters in venues throughout the state of California. Ms. Mihai has trial experience in California Superior Court, as well as, the U.S. District Court, Central District of California. Ms. Mihai has also prevailed after oral argument before the California Fourth District Court of Appeal, and she has obtained an affirming result from the U.S. Court of Appeals for the Ninth Circuit. She has been successful on motions for summary judgment on issues involving bona fide purchasers for value, real estate non-disclosure and the Trivial Defect Doctrine. Ms. Mihai has spoken on and/or moderated panels for Realty One Group (ROG) Summits, PARMA, OCRIMS, MAGNA, ACIG, Perrin Conferences and various insurance carriers and third party administrators. Seminar topics have included Orthopedic and Traumatic Brain Injuries, ADA and Fair Housing, California Residential Purchase Agreement Topics, Reverse Reptile Theory, Negotiations, and Ethics of the Tripartite Relationship.
Ms. Mihai earned her Juris Doctorate from Whittier Law School (WLS). She also obtained a Certificate in International and Comparative Law. While at WLS, she was Research Editor for the Whittier Law Journal of Child and Family Advocacy. She published an article entitled, “The Trafficking of Children: A Modern Form of Slavery, Using the Alien Tort Statute to Provide Legal Recourse,” in the 2006 Whittier Journal of Child and Family Advocacy. Ms. Mihai obtained her Bachelor of Arts degree in International Studies and Spanish from the University of North Carolina at Chapel Hill (UNC). While studying at UNC, Ms. Mihai lived and studied in Seville, Spain.
