Josh Malone has represented both private and public companies and individuals in civil and criminal matters, from the pre-litigation counseling stage through trial. His clients have spanned a wide range of organizations, in industries ranging from consumer products to financial services to sports and entertainment, with a particular focus on technology companies.
His day-to-day civil litigation work is focused primarily on directing case strategy, motion practice, courtroom advocacy, discovery, and negotiating with opposing counsel. In this capacity, Josh has taken and defended depositions, prepared witnesses for trial, conducted oral arguments, drafted numerous dispositive and discovery motions, prepared opening and closing arguments, and counseled many clients on various aspects of litigation risk and strategy. He is a true trusted advisor and counselor to clients who have an enormous amount at stake.
Prior to the onset of litigation, Josh has also counseled numerous consumer-facing clients regarding the legal risks associated with the development and marketing of their products, particularly with issues of consumer protection, privacy, and unfair business practices.
Josh’s white-collar practice involves representing clients in various state, federal, and regulatory proceedings, including investigations by the Department of Justice, California Attorney General Office, and the Securities and Exchange Commission. He has also represented numerous clients in sensitive internal investigations, and he has experience interviewing executives, counseling clients on criminal exposure, and presenting investigation findings to Boards of Directors.
Josh also served a several-month secondment at the San Francisco District Attorney Office, where he delivered opening and closing arguments, examined witnesses, and achieved favorable jury verdicts in each of the cases he took to trial. Josh has an active pro bono practice, where he has, for example, assisted veterans in earning VA benefits and represented indigent criminal clients in the sentencing stage and in vacating prior convictions.
He served as an extern for the Honorable Garland E. Burrell, Jr. for the U.S. District Court of the Eastern District of California.
