Charles P. Kennedy

Of Counsel at Lerner David

Chuck Kennedy has demonstrated a talent in litigating intellectual property cases by translating highly complex technologies and factual scenarios into understandable themes. By a focused game plan from the start, he effectively advocates the client's case before both judges and juries.

To serve a full range of clients from privately held businesses to large multi-national companies, Chuck understands that costs and goals must be determined at the outset. Focusing on the big picture, he will protect the client's intellectual property and obtain damages for infringement, as well as defend clients wrongly accused of infringement.

Chuck's track record includes: multiple cases protecting a chair manufacturer's designs against patent and trade dress infringement through injunctions and damages recovery; multiple cases for obtaining injunctions and damages for a product advertised on national TV; multiple cases protecting the trade dress rights in an innovative lamp design; multiple cases defending large electronics companies against massive damages claims; and various cases defending retail stores, food companies, and pharmaceutical and vitamin distributors against claims of trademark and trade dress infringement. He is equally proud of the many cases he settled successfully when the adversary recognized his ability and commitment to litigating the case. Such recent settlement results include obtaining a settlement payment at trial for a manufacturer of tablet coating equipment, and obtaining an injunction and recovery of attorney's fees for a research laboratory.

Chuck has been recognized in the legal profession for his litigation and advocacy skills. He has been a "leading lawyer" in intellectual property in Chambers USA Directory since 2007. He has been recognized in Best Lawyers in America since 2006. In 2012, he was selected as Best Lawyers "Lawyer of the Year" for Litigation-Intellectual Property in New Jersey.

Chuck brings the same focused approach to appeals of intellectual property cases before United States Courts of Appeals, most frequently in the Federal Circuit. His approach of simplifying the issues and focusing on the big picture has earned him a strong record of success on appeals.

While handling an active litigation calendar, Chuck has always found time to counsel clients from start‑up companies to large established corporation on trademark matters. His experience from litigating trademark cases allows him to guide clients to optimize the value of their trademarks.

Chuck has always been an active contributor to their legal system. Chuck has lectured on various aspects of intellectual property law. Since 1999, he has authored the section on Intellectual Property in New Jersey Federal Civil Practice. For 20 years, he has been a co‑chair and master in the John C. Lifland American Inn of Court, a group devoted to teaching lawyers.
