Kelly Hwang is a partner of the firm. She has over 17 years of experience in all aspects of IP including patent procurement, post-grant proceedings, clearance opinions, due diligence, as well as pharmaceutical patent litigation brought under the Hatch-Waxman Act. Kelly is one of the leaders in both chemical and pharmaceutical technology teams of Lerner David.
Based on her track record of obtaining favorable outcomes, clients frequently trust Kelly with the most difficult cases. Her success, in part, comes from her ability to convey complex technologies and legal issues in a simple and straightforward manner, and her creative legal solutions. Her skills in explaining technology arise, in part, from her work as an engineer in the chemical/mechanical industry for over 4 years. She is also a first named inventor of a U.S. patent based on her work as an engineer.
Kelly is fluent in Korean and Japanese. She makes frequent trips to Asia to advise the firm’s Asia-based clients on U.S. patent and trademark law. She is knowledgeable about the programs available at patent offices around the world and assists clients in creating a valuable global patent portfolio in a cost efficient manner. Her object is to craft quality patent portfolios and provide innovative IP legal strategies to add value to clients’ global IP assets. Kelly manages numerous IP portfolios for various multinational corporations. Kelly also works with many of the attorneys to help them formulate arguments to effectively address issues raised by the examiners worldwide. Kelly’s efforts have contributed to Lerner David being a top firm in the technology centers focusing on chemical and materials engineering related inventions at the U.S. Patent Office.
Kelly creates and implements dynamic IP strategies based on a careful listening to client’s concerns and goals and clearly communicating risks and benefits on strategic options to the clients. Kelly respects the expertise that a client brings to the legal analysis and includes a client’s non-legal considerations as part of the legal counseling. In doing so, she provides a solution which meets the client’s short term and long term goals.
