Michael is an experienced litigator whose practice focuses on construction, securities, and real estate disputes.

Michael represents owners, contractors, subcontractors, and material suppliers in a wide array of disputes involving construction projects, including construction and design defects, scope issues, risk allocation, delays, changes, indemnification, termination, mechanic’s liens, payment, Prompt Pay Act, and collections. He has experience with numerous construction delivery methods including design-bid-build, design-build, construction manager at risk, job order contracting, and others, as well as various types of architectural and engineering agreements. He works with clients on licensing issues and has represented owners, contractors, and subcontractors in licensing and other proceedings before the Arizona Registrar of Contractors. Having represented participants on all sides of public and private construction projects, he is able to offer a comprehensive perspective to his clients.

Michael is an active member of the State Bar of Arizona’s Construction Law Section and regularly attends and speaks at its events. He is also a frequent speaker to the Arizona Builders Alliance and other construction industry groups.

Michael represents broker-dealers, registered representatives, and registered investment advisers in court, in arbitration proceedings before the Financial Industry Regulatory Authority, and before state and federal regulatory bodies in a wide variety of disputes involving customer suitability and supervision claims, employment-related claims, securities fraud, and expungement. Michael also advises clients on FINRA, SEC, and state regulations and licensing-related matters as well as compliance and supervisory system design. Before attending law school, Michael worked for a national securities brokerage firm, and this background enables him to provide additional insights and experience to his securities clients.

Michael’s real estate litigation practice includes representations involving judicial and non-judicial foreclosures, agreements for sale, loan repayment, deficiency judgments, lender liability, easements, deed restrictions, quiet title actions, landlord/tenant matters, and other disputes concerning real property.

While Michael’s primary focus is litigation and dispute resolution, he routinely deploys the “lessons learned” in prior litigated matters and consults with clients in his areas of expertise to advise them on best practices and strategy before disputes arise, with an eye toward early and efficient resolution of potential claims.
