David W. Phillips is an experienced trial lawyer, focusing on complex, sophisticated litigations, including false advertising, trademark, copyright and unfair competition claims, contract claims, fraud and RICO claims, franchise litigations, shareholder disputes and construction litigations.
In his nearly 30 years of practice, Mr. Phillips has tried numerous jury and non-jury cases, winning substantial verdicts, and successfully defending substantial claims. Mr. Phillips primarily practices in the state and federal courts sitting in New Jersey and New York, and has also handled cases in state and federal courts across the country, as well as before the American Arbitration Association, the International Centre for Dispute Resolution, the National Association of Securities Dealers and private arbitrators. He has also argued appeals before the appellate courts of New Jersey and New York, and the Second and Third Circuit Courts of Appeal.
Mr. Phillips has authored a number of articles on significant intellectual property issues, as well as other subjects. Mr. Phillips has been asked to speak several times at the New Jersey State Bar Convention, and has lectured often at seminars sponsored by private organizations, on a number of topics, including intellectual property, enforcement of foreign arbitration awards and the sub-prime mortgage crises.
