Andrew Spitz

Mr. Spitz has been practicing law for 35 years, and he aims to give every client the full benefit of his lengthy and well rounded experience. He has handled thousands of dispositive motions and appeals on such topics as municipal liability, premises liability, Labor Law, products liability and automotive liability. He has handled over 125 appeals before all four New York State Appellate Division Judicial Departments, New York State Court of Appeals, and United State Court of Appeals, Second Circuit. He has also handled dispositive motions in all New York Federal Courts and in most Supreme Court venues in the State.

Mr. Spitz has won numerous appeals protecting the rights of injured workers at construction sites, as well as the rights of persons injured because of dangerous conditions on property. Some of his most recent successes include, Dewitt V. Poovey, 111 AD3rd 540 (upholding liability claim of plaintiff who fell from a float being towed by a motorboat.).

Kochman V. City of New York, 110 AD3rd 477 (upholding viability of claim by injured worker who fell while modifying a telephone line.).

Kase V.H.E.E. Co., 95 AD3rd 568 (upholding viability of claim of injured Plaintiff who fell on ice in the street which was caused by commercial activity on an adjoining property).

Schick V. 200 Blydenburgh, LLC., 88 AD3rd 684 (upholding viability of claim by an injured worker against both landlord and commercial tenant where Plaintiff fell from a ladder while installing a telephone line.).

Andy has lectured at Continuing Legal Education seminars for Orange County attorneys on such topics as Labor Law.
