Jamie Flanagan is an experienced advocate who has guided his clients through difficult times for more than 30 years. Focusing on civil litigation, he handles commercial and construction litigation, employment law disputes, and estate litigation.

When a matter proceeds to trial, Jamie has the litigation experience to aggressively and thoroughly pursue his clients' interests. He has appeared before the provincial, superior, and appeal courts of Alberta, British Columbia, and Saskatchewan on a wide variety of cases.

Jamie spends the time helping his clients decide the best approach to their litigation proceedings. He gives practical advice on the benefits and disadvantages of settling a dispute because he understands litigation can be costly, time-consuming, and stressful.

His experience covers all phases of civil litigation, including preparing opinions, drafting pleadings, chambers applications, examinations for discovery, trial, and appeal. He has particular skill handling complex, multi-party, multi-issue litigation involving extensive documentation and multiple experts, and managing the steps required to enforce judgments. On multiple occasions, Jamie has also been involved in the unique applications that can arise in civil litigation, such as interim injunctions, Mareva injunctions, and Anton Pillar applications.

In construction litigation, Jamie acts for contractors, owners, and developers in construction disputes. His experience includes delay claims, performance bonds, as well as labor and material payment bond claims involving sureties, tendering disputes, deficiencies, defective construction, negligence claims against design professionals, and a wide variety of breach of contract claims. He has decades of experience and a thorough understanding of the technical requirements of builders' lien claims under the Builders’ Lien Act. He has acted for owners, general contractors, subcontractors, material suppliers, and others in the construction industry in both enforcing lien rights and challenging lien claims.

His commercial litigation practice includes oil and gas litigation, pipeline failures, shareholder disputes, professional negligence claims, insolvency matters, secured and unsecured creditor remedies, real estate disputes, commercial landlord and tenant claims, and product liability actions.

Jamie has also helped many of his clients navigate the estate litigation process, including the validity of wills, capacity challenges, undue influence, executor duties and conflicts, fiduciary and trust claims, power of attorney issues, executor compensation, and foreign estate limitations.

In his employment law practice, Jamie advises employers of all sizes across a broad range of industry sectors. He handles issues including employment standards, short- and long-term disability claims, fiduciary obligations, directors' liability, wrongful dismissal, and labor and employment issues in commercial transactions. He also drafts and enforces employment contracts and assists with non-competition, non-solicitation, and confidentiality agreements.
